  1. appropriation therefor.
  2.  
  3.     (2) The Director of Correction shall:
  4.  
  5.     (a) supervise and be responsible for the administration of 
  6. the Department;
  7.  
  8.     (b) establish and administer, with the advice of the 
  9. Commission of Correction and Community Services, programs and 
  10. policies for the operation of the institutions in the Department, 
  11. and for the correction and rehabilitation of prisoners;
  12.  
  13.     (c) appoint and remove deputy directors as provided by law 
  14. and delegate appropriate powers and duties to them;
  15.  
  16.     (d) appoint and remove subordinate officers of the 
  17. Department, other than the Board and Division of Parole [Division 
  18. of Probation and Parole], in accordance with law, and delegate 
  19. appropriate powers and duties to them;
  20.  
  21.     (e) make rules and regulations for the government, 
  22. correctional treatment and rehabilitation of prisoners, the 
  23. administration of institutions in the Department, and the 
  24. regulation of officers and employees under his jurisdiction;
  25.  
  26.     (f) order the assignment and transfer of prisoners committed 
  27. to the custody of the Department of Correction to institutions of 
  28. the Department;
  29.  
  30.     (g) collect, develop and maintain statistical information 
  31. concerning offenders, sentencing practices and correctional 
  32. treatment as may be useful in practical penological research or 
  33. in the development of treatment programs;
  34.  
  35.     (h) exercise, in accordance with law, supervisory power over 
  36. all institutions in the State for the detention of persons 
  37. charged with or convicted of an offense, or for the safekeeping 
  38. of such other persons as may be remanded thereto in accordance 
  39. with law;
  40.  
  41.     (i) transmit to the Governor annually, on or before the
  42.  
  43.         day of     , a detailed report of the operations of the 
  44. Department for the preceding calendar year, which report shall be 
  45. transmitted by the Governor to the legislature;
  46.  
  47.     (j) exercise all powers and perform all duties necessary and 
  48. proper in carrying out his responsibilities.

  50. 401.3. Organization of Department of Correction
  51.  
  52.     (1) There shall be in the Department of Correction the 
  53. following divisions and independent boards: 
  54.     (a) Division of Treatment Services; 
  55.  
  56.     (b) Division of Custodial Services; 
  57.  
  58.     (c) Division of Young Adult Correction; 
  59.  
  60.     (d) Division of Fiscal Control; 
  61.  
  62.     (e) Division of Prison Industries; 
  63.  
  64.     (f) Division of Research and Training;
  65.  
  66.     (g) Division of Parole
  67.  
  68.     (h) Division of Probation:
  69.  
  70.     (i) Commission of Correction and Community Services;
  71.  
  72.     (j) Board of Parole.

  74.     The Director of Correction may, after consultation with and 
  75. on the advice of the Commission of Correction and Community 
  76. Services, establish additional divisions, consolidate such 
  77. additional divisions with other divisions, or abolish them, and 
  78. he may establish, consolidate or abolish bureaus or other 
  79. administrative subdivisions in any division.

  81.     (2) There shall be in each institution in the Department of 
  82. Correction a warden or other administrative head and [two] 
  83. associate wardens or administrative heads [designated, 
  84. respectively, as associate warden on treatment and associate 
  85. warden on custody]. The Warden in each institution shall be 
  86. responsible to the Director of Correction for the custody, 
  87. control and correctional treatment of prisoners and for the 
  88. general administration of the institution. Associate wardens in 
  89. each institution shall advise and be responsible to the Warden, 
  90. and shall have such powers and duties as the Warden may delegate 
  91. to them in accordance with law or pursuant to the directions of 
  92. the Director of Correction.

  94. 410.4. Division of Treatment Services; Deputy Director
  95.  
  96. for Treatment Services
  97.  
  98.     (1) The Division of Treatment Services shall be charged with 
  99. the supervision of programs of education and training, including 
  100. academic, vocational and industrial training, and correctional 
  101. treatment and rehabilitation, and parole preparation in the 
  102. institutions of the Department, excepting only institutions for 
  103. young adult offenders.

  106.     (2) The Division of Treatment Services shall be headed by 
  107. the Deputy Director of Treatment Services, who shall act as the 
  108. staff advisor of the Director of Correction in regard to 
  109. correctional treatment, and who shall exercise such power and 
  110. perform such duties as the Director of Correction may delegate to 
  111. him.  The Deputy Director of Treatment Services shall be 
  112. appointed by, and serve during the pleasure of, the Director of 
  113. Correction. He shall be a person with appropriate experience in 
  114. the field of education, correctional treatment or rehabilitation, 
  115. and appropriate training in relevant disciplines. His salary 
  116. shall be fixed by the Governor [the Director of Correction] 
  117. within the appropriation therefor.

  119. 401.5. Division of Custodial Services; Deputy Director for
  120.  
  121. Custodial Services
  122.  
  123.     (1) The Division of Custodial Services shall be charged with 
  124. the custody, control, safekeeping, protection and discipline of 
  125. prisoners in the institutions of the Department, excepting only 
  126. institutions for young adult offenders.
  127.  
  128.     (2) The Division of Custodial Services shall be headed by 
  129. the Deputy Director for Custodial Services, who shall act as the 
  130. staff advisor of the Director of Correction in regard to matters 
  131. of custody and discipline, and who shall exercise such powers and 
  132. perform such duties as the Director of Correction may delegate to 
  133. him. The Deputy Director for Custodial Services shall be 
  134. appointed by, and serve during the pleasure of, the Director of 
  135. Correction. He shall be a person with appropriate experience in a 
  136. position of responsibility in the management of institutions or 
  137. in law enforcement work. His salary shall be fixed by the 
  138. Governor [the Director of Correction] within the appropriation 
  139. therefor.

  141. 410.6  Division of Young Adult Correction; Deputy Director for 
  142. Young Adult Correction
  143.  
  144.     (1) The Division of Young Adult Correction shall be charged 
  145. with the supervision of institutions and facilities for the 
  146. custody, control, treatment and rehabilitation of young adult 
  147. offenders, and in cooperation with the Commission of Correction 
  148. and Community Services, with the planning and establishment of 
  149. diversified facilities and programs for the treatment and 
  150. rehabilitation of young adult offenders.

  152.     (2) The Division of Young Adult Correction shall be headed 
  153. by the Deputy Director for Young Adult Correction, who shall act 
  154. as the staff advisor of the Director of Correction in regard to 
  155. matters of custody, control and treatment of young adult 
  156. offenders, and who shall exercise such powers and perform such 
  157. duties as the Director of Correction may delegate to him. The 
  158. Deputy Director for Young Adult Correction shall be appointed by, 
  159. and serve during the pleasure of, the Director of Correction. He 
  160. shall be a person with appropriate experience in the fields of 
  161. youth guidance, correctional treatment and rehabilitation, or 
  162. appropriate training in relevant disciplines at a recognized 
  163. university. His salary shall be fixed by the Governor [the 
  164. Director of Correction] within the appropriation therefor.

  166. 401.7. Division of Prison Industries; Deputy Director for prison 
  167. Industries
  168.  
  169.     (1) The Division of Prison Industries shall be charged with 
  170. the general supervision of industries in the institutions of the 
  171. Department.
  172.  
  173.     (2) The Division of Prison Industries shall be headed by the 
  174. Deputy Director for Prison Industries, who shall be the staff 
  175. advisor of the Director of Correction in regard to the industries 
  176. in the institutions of the Department, and who shall exercise 
  177. such powers and perform such duties as the Director of Correction 
  178. may delegate to him. The Deputy Director for Prison Industries 
  179. shall be appointed by, and serve during the pleasure of, the 
  180. Director of Correction. He shall be a person with appropriate 
  181. experience in the management of institutional industries, or in 
  182. industrial management. His salary shall be fixed by the Governor 
  183. [the Director of Correction] within the appropriation therefor.
